Spearpoint Training & Performance, LLC Terms & Conditions

1. Membership

   • The term "membership" is intended to imply an agreement between the purchaser ("Member") and Spearpoint Training & Performance, LLC ("Spearpoint") for the purposes of payment and the terms and conditions contained herein.

   • Purchasing a program does not enter the Member into a recurring payment plan with Spearpoint.

   • Spearpoint reserves the right to terminate a membership for any breach of these terms or any other reasons, as determined.

2. Fitness Assessment

   • All Members must complete a fitness assessment to the best of their ability and with honest responses prior to the development of any fitness program.

3. Liability Waiver

   • Members assume all risk of personal injury, death or property loss resulting from any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care.

4. Payment and Fees

   • Members agree to pay all applicable fees, charges and taxes for their selected membership type,

   • Late or returned payments may be subject to additional fees.

5. Cancellation and Refund Policy

   • Individual Plans - all sales are final and are due at the time of purchase. No refunds are available for these plans.

   • Monthly Memberships - These are non-recurring payments. Members will not be charged until they decide to continue with the next month of the program. Refunds are not available for previous months or once the program for the current month has been sent to the member.

   • Yearly Memberships - Members wishing to cancel their yearly membership must do so by providing written notice according to the terms of their membership agreement. Members will be responsible for all fees paid current through the time of the cancellation. Refunds will be issued for the remaining months of the membership; however, members will incur a cancellation fee in the amount of the discount balance received for the time the membership was active.

6. Personal Information and Privacy

   • Spearpoint values and appreciates your privacy. Absolutely no personal membership information will ever be shared with any third party, entity or corporation, for any purpose, without the written consent of the member. 

7. Changes to Terms & Conditions

   • Spearpoint reserves the right to change these terms and conditions at any time. Members will be notified of any significant changes.

8. Miscellaneous

   • These terms are governed by the law of the Commonwealth of Massachusetts.

   • If any provision is found to be unenforceable, the remaining provisions will continue to be in effect.
